Le parti precisano le conclusioni come da verbale del 5/4/2012.

IL TRIBUNALE


udita  la relazione della causa svolta dal Giudice Istruttore Dott. Giovanni  Fanticini, udita la lettura delle conclusioni prese dai procuratori  delle parti, esaminati gli atti e i documenti di causa,

ha così ritenuto:

CONCISA ESPOSIZIONE DELLE RAGIONI DI FATTO E DI DIRITTO DELLA DECISIONE


Con  ricorso depositato il 5/11/2009 ***** ricorreva al Tribunale chiedendo  la separazione personale dal coniuge *** con il quale aveva contratto  matrimonio in data 27/4/1999 in Nigeria: la ricorrente asseriva che il  rapporto matrimoniale si era deteriorato a causa dei comportamenti del  convenuto (affermava che il convenuto aveva usato violenza, psicologica e  fisica, nei suoi confronti) e che la convivenza era divenuta  intollerabile;

dall’unione erano nati i figli *** e ***; chiedeva  la pronuncia di separazione con addebito al marito, l’affidamento  esclusivo dei figli, la determinazione di un contributo di mantenimento  della prole.

All’udienza del 19/1/2010 solo la ricorrente  compariva innanzi al Presidente del Tribunale che confermava  l’affidamento dei minori ai Servizi Sociali (già stabilito dal Tribunale  per i Minorenni) e fissava un assegno di mantenimento in favore dei  figli.

Con comparsa del 25/5/2010 si costituiva in giudizio ***,  il quale si associava all’istanza di separazione ma chiedeva di  rigettare la domanda di addebito; chiedeva altresì la conferma dei  provvedimenti presidenziali riguardanti i minori.

Previo intervento del Pubblico Ministero, le parti comparivano innanzi al G.I. per la prosecuzione.
Con ordinanza del 28/10/2010 il G.I. provvedeva sulle istanze probatorie.

All’udienza  del 24/2/2011 la ricorrente rinunciava – e la controparte accettava –  alla domanda di addebito; a detta udienza, fissata anche per  l’assunzione del suo interrogatorio formale, ometteva di comparire il  convenuto, il quale non ha fornito, nemmeno in seguito, alcuna  giustificazione per la mancata comparizione; nel prosieguo la parte  ricorrente non insisteva per l’assunzione delle altre prove orali;  veniva acquisita relazione dei competenti Servizi Sociali.
All’udienza  del 5/4/2012 le parti precisavano le conclusioni; concessi i termini  per le difese finali, il G.I. rimetteva la causa al Collegio per la  decisione.

§ § §


1.  Preliminarmente e in rito, si deve rilevare che la domanda di unificare  l’assegno periodico di mantenimento e una somma a forfait per spese  straordinarie mensili non può reputarsi nuova e tardiva, atteso che sul  contributo per la prole il Tribunale ha poteri officiosi che prescindono  dalle richieste delle parti e, pertanto, l’istanza della ricorrente  mira soltanto a sollecitare l’esercizio di tali poteri.
Lo stesso  deve dirsi con riguardo alla produzione di documentazione (con la  conclusionale e, quindi, consentendo alla controparte la difesa con la  replica) utile alla decisione sul contributo per il mantenimento, stanti  i poteri istruttori officiosi riconosciuti dall’art. 155-sexies c.c.

2.  Poiché entrambi i coniugi sono cittadini nigeriani, il primo problema  da risolvere riguarda la legge da applicarsi in questa causa: infatti,  ai sensi dell’art. 14 delle legge 218/1995, il Giudice è gravato  dell’obbligo di accertare d’ufficio la legge straniera eventualmente  applicabile al rapporto in forza delle disposizioni di diritto  internazionale privato (segnatamente, l’art. 31 L. 218/1995). In realtà,  il principio iura novit curia, anche riguardo al diritto straniero, pur  non codificato precedentemente, era pacificamente riconosciuto dalla  giurisprudenza, che, tuttavia, ne aveva mitigato le eccessive  conseguenze con il riconoscere sussistente sempre e comunque un onere di  allegazione delle parti; tale concezione è confluita anche nella norma  dell’art. 14 L. 218/1995, la quale, al comma 2°, evidenzia come le parti  debbano collaborare con il Giudice nel fornire indicazioni al riguardo.

Nel  caso, l’ordinamento della Nigeria contempla l’istituto della  separazione tra coniugi ai paragrafi 39 e seguenti del Matrimonial  Causes Act: si tratta, in particolare, di una separazione giudiziale non  dissimile da quella disciplinata del nostro ordinamento come si evince  dalla sintetica disposizione del paragrafo 41 (“A decree of judicial  separation relieves the petitioner from the obligation to cohabit with  the other party to the marriage while the decree remains in operation,  but, except as provided by this Part, it shall not otherwise affect the  marriage or the status, rights and obligations of the parties to the  marriage”).

La legge nigeriana (paragrafo 39: “Subject to this  Part, a petition under this Act by a party to a marriage for a decree of  judicial separation may be based on one or more of the facts and  matters specified in sections 15(2) and 16(l) of this Act.”) pone varie  condizioni per la separazione:

  • Paragrafo 15(2): The court  hearing a petition for a decree of dissolution of a marriage shall hold  the marriage to have broken down irretrievably if, but only if, the  petitioner satisfies the court of one or more of the following facts-

(a) that the respondent has wilfully and persistently refused to consummate the marriage;

(b) that since the marriage the Respondent has committed adultery and  the petitioner finds it intolerable to live with the respondent;

(c) that since the marriage the respondent has behaved in such a way  that the petitioner cannot reasonably be expected to live with the  respondent;

(d) that the respondent has deserted the  petitioner for a continuous period of at least one year immediately  preceding the presentation of the petition;

(e) that the  parties to the marriage have lived apart for a continuous period of at  least two years immediately preceding the presentation of the petition  and the respondent does not object to a decree being granted;

(f) that the parties to the marriage have lived apart for a continuous  period of at least three years immediately preceding the presentation of  the petition;

(g) that the other party to the marriage has,  for a period of not less than one year failed to comply with a decree or  restitution of conjugal rights made under this Act;

(h) that  the other party to the marriage has been absent from the petitioner for  such time and in such circumstances as to provide reasonable grounds  for presuming that he or she is dead.

  • paragrafo 16(1):  Without prejudice to the generality of section 15(2)(c) of this Act, the  court hearing a petition for a decree to of dissolution of marriage  shall hold that the petitioner has satisfied the court of the fact  mentioned in the said section 15(2)(c) of this Act if the petitioner  satisfies the court that-

(a) since the marriage, the respondent has committed rape, sodomy, or bestiality; or

(b) since the marriage, the respondent has, for a period of not less than two years-

(i) been a habitual drunkard, or

(ii) habitually been intoxicated by reason of taking or using to  excess any sedative, narcotic or stimulating drug or preparation, or  has, for a part or parts of such a period, been a habitual drunkard and  has, for the other part or parts of the period, habitually been so  intoxicated; or

(c) since the marriage, the respondent has within a period not exceeding five years-

(i) suffered frequent convictions for crime in respect of which  the respondent has been sentenced in the aggregate to imprisonment for  not less than three years, and

(ii) habitually left the petitioner without reason- able means of support; or

(d) since the marriage, the respondent has been in prison for a period  of not less than three years after conviction for an offence punishable  by death or imprisonment for life or for a period of five years or  more, and is still in prison at the date of the petition; or

(e) since the marriage and within a period of one year immediately  preceding the date of the petition, the respondenthas been convicted of-

(i) having attempted to murder or unlawfully to kill the petitioner, or

(ii) having committed an offence involving the intentional  infliction of grievous harm or grievous hurt on the petitioner or the  intent to inflict grievous harm or grievous hurt on the petitioner;

(f) or the respondent has habitually and wilfully failed, throughout  the period of two years immediately preceding the date of the petition,  to pay maintenance for the petitioner-

(i) ordered to be paid under an order of, or an order registered in, a court in the Federation, or

(ii) agreed to be paid under an agreement between the parties to the marriage providing for their separation; or

(g) the respondent-

(i) is, at the date of the petition, of unsound mind and unlikely to recover, and

(ii) since the marriage and within the period of six ears  immediately preceding the date of the petition, as been confined for a  period of, or for periods aggregating, not less than five years in an  institution where persons may be confined for unsoundness of mind in  accordance with law, or in more than one such institution.

Come  si evince dalle citate norme, non è prevista la separazione con addebito  (alla relativa domanda ha comunque rinunciato la ricorrente) ma solo la  separazione per “giusta causa” (tra quelle incluse nell’elenco).

Ritiene  il Collegio che, nella fattispecie in esame, possa configurarsi la  situazione delineata dal paragrafo 15(2)(c) e, cioè, “that since the  marriage the respondent has behaved in such a way that the petitioner  cannot reasonably be expected to live with the respondent” (in altri  termini, il comportamento del convenuto dev’essere tale da non rendere  ragionevolmente accettabile, da parte del ricorrente, la prosecuzione  della convivenza).

La mancata comparizione del convenuto –  corroborata dai certificati medici in atti – consente di ritenere  provate le circostanze dedotte nei capitoli di prova ammessi e, cioè, i  plurimi episodi di violenza domestica subiti dalla ricorrente. Il  reiterato ricorso alla violenza fisica da parte dell’odierno resistente  costituisce certamente condotta grave e tale da rendere intollerabile la  prosecuzione della convivenza anche in base al disposto della legge  nigeriana.

3. Con riguardo all’affidamento e al mantenimento della prole, la legge della Nigeria prevede:

  • paragrafo 71:

(1) In proceedings with respect to the custody guardianship, welfare,  advancement or education of children of a marriage, the court shall  regard the interests of those children as the paramount consideration;  and subject thereto, the court may make such order in respect of those  matters as it thinks proper. …

(3) In proceedings with  respect to the custody of children of a marriage, the court may, if it  is satisfied that it is desirable to do so, make an order placing the  children, or such of them as it thinks fit, in the custody of a person  other than a party to the marriage.

(4) Where the court makes  an order placing a child of a marriage in the custody of a party to the  marriage, or of a person other than a party to the marriage, it may  include in the order such provision as it thinks proper for access to  the child by the other party to the marriage, or by the parties or a  party to the marriage, as the case may be.

  • paragrafo 72:


(1) The court may, in proceedings under this Act, by court in order  require the parties to the marriage, or either of them, to make, for the  benefit of all or any of the parties to, and the children of, the  marriage, such a settlement of property to which the parties are, or  either of them is, entitled (whether in possession or reversion) as the  court considers just and equitable in the circumstances of the case.

(2) The court may, in proceedings under this Act, make such order as  the court considers just and equitable with respect to the application  for the benefit of all or any of the parties to, and the children of,  the marriage of the whole or part of property dealt with by ante-nuptial  or post-nuptial settlements on the parties to the marriage, or either  of them.

  • paragrafo 73:

(1) The court, in  exercising its powers under this Part of this Act, may do any or all of  the following, that is to say, it may-

(a) order that a lump sum or a weekly, monthly, yearly or other periodic sum be paid;

(b) order that a lump sum or a weekly, monthly, yearly or other periodic sum be secured;

(c)  when a periodic sum is ordered to be paid, order that its payment be  wholly or partly secured in such manner as the court directs;

(d)  order that any necessary deed or instrument be executed, and that the  documents of title be produced or such other things be done as are  necessary to enable an order to be carried out effectively or to provide  security for the due performance of an order;

(e) appoint or  remove trustees; order that payments be made direct to a party to the  marriage, or to a trustee to be appointed or to a public officer or  other authority for the benefit of a party to the marriage;

(g)  order that payment of maintenance in respect of a child be made to such  persons or public officer or other authority as the court specifies;

(h)  make a permanent order, an order pending the disposal of proceedings,  or an order for a fixed term or for a life or during joint lives, or  until further order,

(i) impose terms and conditions;

(j)  in relation to an order made :in respect of a matter referred to in  section 70, 71 or 72 of this Act, whether made by the court or by  another court, and whether made before or after the commencement of this  Act,-



(l) make any other order (whether or not  of the same nature as those mentioned in the preceding paragraphs of  this subsection, and whether or not it is in accordance with the  practice under any other enactment or law before the commencement of  this Act) which it thinks it is necessary to make to do justice.

Dalle  disposizioni emerge che il Tribunale ha – come nell’ordinamento  italiano – il compito di salvaguardare l’interesse della prole –  obiettivo primario – e a tal fine può adottare un’ampia gamma di  provvedimenti, compresi l’affidamento monogenitoriale o eterofamiliare,  la determinazione di contributi economici e l’adozione di misure atte a  garantire il mantenimento.

Osserva il Collegio che, in base alla  relazione dei Servizi Sociali, il resistente è stato a lungo “latitante”  coi figli (scarsi contatti, anche telefonici) nonostante il desiderio  degli stessi di avere un rapporto più intenso con lui; solo recentemente  *** pare aver assunto maggiore consapevolezza del proprio ruolo  genitoriale e si è anche la tensione tra i coniugi si è allentata, tanto  che la stessa ricorrente “si mostra concorde rispetto all’eventuale  possibilità che i coniugi possano incontrare liberamente il padre”.

La  figura genitoriale materna appare positiva e, ferme restando le  determinazioni del Tribunale per i Minorenni, non si ravvisano ostacoli  ad individuare la madre come genitore affidatario

Di contro, pur  concordando sulla possibilità di incontri “liberi” (cioè, non sottoposti  alla vigilanza dei Servizi Sociali) tra il padre e i figli, le condotte  del medesimo (violenze perpetrate nel corso della convivenza  matrimoniale, presumibilmente alla presenza dei figli; assenze  prolungate e scarsi contatti con la prole) inducono a ritenere  potenzialmente nocivo per i minori un affidamento condiviso; il padre  potrà incontrare i figli e tenerli con sé secondo il calendario che sarà  predisposto dai competenti Servizi Sociali, misura questa che appare  idonea a contemperare le esigenze di tutela della prole e di ausilio  alla (debole) figura paterna.

Le condizioni economiche delle  parti non sono controverse e nemmeno vi è discordia sull’ammontare del  contributo periodico: infatti, entrambi i contendenti concordano  sull’entità del contributo periodico (Euro 250,00 mensili per ciascun  figlio), mentre divergono le interpretazioni sul concetto di spese  straordinarie (addossate in pari misura alle parti in forza  dell’ordinanza del Presidente del Tribunale).

Reputa questo  Collegio che non sia opportuno – come invece sembrerebbero chiedere le  parti – elencare le spese straordinarie, che sono eterogenee e mutevoli a  seconda dello sviluppo dei figli; sembra piuttosto più ragionevole  stabilire un contributo periodico più elevato che comprenda quindi anche  le spese straordinarie (a mero titolo esemplificativo, quelle per gite  d’istruzione o acquisto di libri di testo) restando escluse soltanto le  spese impreviste, legate ad eventi futuri che non possono essere  ragionevolmente preveduti (ad esempio, per cure mediche particolari  legate a sopravvenute patologie o a incidenti). Si determina, perciò,  che il convenuto versi alla ricorrente, a titolo di contributo al  mantenimento della prole, la somma mensile di Euro 650,00 (Euro 325,00  per ciascun figlio), somma rivalutabile annualmente secondo indici Istat  dall’agosto 2013, oltre al 50% delle spese impreviste (come sopra  qualificate).

Si conferma anche l’ordine di pagamento diretto da  parte del datore di lavoro, misura che consente di “secure the payment”,  come previsto dalla legge nigeriana.

4. La prevalente soccombenza del resistente comporta giustifica la sua condanna alla rifusione delle spese del giudizio.

P.Q.M.IL TRIBUINALE DI REGGIO EMILIA


definitivamente  pronunciando sull’azione promossa da ***** nei confronti di *** con  l’intervento del Pubblico Ministero, così provvede:

  • pronuncia  la separazione personale tra i coniugi *** nato in Nigeria e *****  (nata in Nigeria, uniti in matrimonio in Benin City – Nigeria in data  27/4/1999 (come da atto di matrimonio – anno 2008 – parte I – n. 3);
  • ordina ai competenti Ufficiali dello Stato Civile di annotare questa sentenza;
  • affida i figli minori alla madre;
  • il  padre potrà incontrare i figli e tenerli con sé secondo il calendario  che sarà predisposto dai competenti Servizi Sociali (Servizi Sociali  Unione Tresinaro Secchia);
  • dispone che *** versi a  *****, a titolo di contributo al mantenimento della prole, la somma  mensile di Euro 650,00 (Euro 325, per ciascun figlio), somma  rivalutabile annualmente secondo indici Istat dall’agosto 2013, oltre al  50% delle spese impreviste;
  • ordina al datore di lavoro  di *** – Azienda Agricola **, con sede in Rubiera – di Versare  mensilmente a ***** la somma predetta, prelevandola dai compensi dovuti a  ***;
  • condanna *** versi a ***** le spese di lite,  liquidate in complessivi Euro 2.600,00 per diritti e onorari, oltre a  spese generali (12,5%), CPA e IVA;
  • manda la Cancelleria per la comunicazione ai Servizi Sociali Unione Tresinaro Secchia.
